TENT INFORMATION

Henrietta Town and NFPA regulations expanded:   Approval required.  Tents and membrane structures having an area in excess of 200 square feet and canopies in excess of 400 square feet shall not be erected, operated or maintained for any purpose without approval from the code enforement official.  Tent stakes of any kind may NOT be driven into paved surfaces.

EXCEPTIONS:

Tents 10 x 20 feet, Canopies 10 x 40 feet.

1. Tents used exclusively for recreational camping purpose.

2. Fabric canopies and awnings open on all sides which comply with all of the following:

2.1. Individual canopies having a maximum size of 700 square feet.

2.2. The aggregate area of multiple canopies placed side by side without a fire break clearance of 12 feet not exceeding 700 square feet total.

2.3. A minimum clearance of 12 feet to all structures and other tents.

Tents and canopies must fit within your flea market space(s).  If your vehicle and tent occupy a space greater than one parking space (10 x 20 feet), an additional parking space permit must be purchased and displayed.  You should make certain your liability insurance coverage is in place and that it will cover you.  In 2002, a personal injury was sustained.  A tent and a canopy blew down.  Tent (and canopy) owners are personally responsible for any injuries sustained by others.

All other free standing tents are to be located in a special reserved section of the flea market.  Spaces are assigned by hamfest personnel.  All free standing tents are subject to the following conditions:

A tent floor plan along with a fire retardant certificate for all tents must be filed with the Fire Marshal of the Town of Henrietta, N.Y.

SALES TAX

Under NY tax law, each selling vendor must be registered with the New York State Sales Tax Bureau.  Permits must be obtained from the tax bureau in advance.  State tax application form DTF17 and Instructions may be downloaded here.  The form and instructions are in the .pdf format.

Each selling vendor is responsible for collection and payment of sales tax.
